Terms of Service

These Terms of Service ("Terms") govern your use of the TwissInfluencer application and related services (collectively, the "Services") provided by TWISS Brand Studio ("TWISS," "we," "us," or "our"). By using the Services, you agree to these Terms.

1. Use of the Services

The Services enable authorized users to manage Instagram Business and Creator accounts through the Meta Instagram Platform, including content publishing, comment moderation, direct message handling, and analytics retrieval. You may only use the Services in accordance with:

• These Terms
• All applicable laws and regulations in your jurisdiction
• Meta Platform Terms and Instagram Platform Policy
• Instagram Community Guidelines

2. Authorization and Permissions

To use the Services with a particular Instagram account, you must authorize the TwissInfluencer application via Instagram Business Login or grant access through Meta Business Manager. You represent that you have the authority to grant such permissions for any account you authorize.

3. Acceptable Use

You agree not to use the Services to:

• Send unsolicited messages, spam, or content that violates Instagram's Community Guidelines
• Engage in deceptive, fraudulent, or misleading practices
• Distribute malware, harmful content, or content that infringes intellectual property rights
• Harvest user data beyond what is required for stated business purposes
• Attempt to bypass rate limits, security measures, or platform restrictions
• Use the Services for any purpose prohibited by Meta's Platform Policies

4. Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your authentication credentials
• All activity that occurs through accounts you authorize
• Ensuring that content published through the Services complies with all applicable laws and Instagram's policies
• Reviewing and approving AI-drafted responses before they are sent to end users, where applicable

5. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability. The Services may be temporarily unavailable due to maintenance, updates, or factors beyond our control, including service disruptions from Meta's platforms.

6. Intellectual Property

The Services, including all software, designs, and documentation, are owned by TWISS Brand Studio and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer the Services without our written permission.

You retain ownership of content you create and publish through the Services.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWISS BRAND STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or applicable laws. You may stop using the Services at any time by revoking access from your Instagram account settings.

11. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated to active users. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Singapore. Any disputes shall be resolved in the courts of Singapore, without regard to conflict-of-law principles.
